¿Conoces la diferencia entre sufragio y voto?
La Ley No. 72 es la que norma que regula todo lo concerniente al Sistema Electoral y sus procedimientos en Cuba. Su cuerpo legal fue aprobado el 29 de octubre de 1992 por la Asamblea Nacional del Poder Popular, único órgano con potestad constituyente y legislativa de la Nación.
Pero desde los mismos inicios de la Revolución el país no estuvo desprovisto de legislación electoral. La Ley 1305 de 1976 y posteriormente, en el año 1982, se adoptó la Ley No. 37, actualizada diez años después.
El tercer POR CUANTO de la normativa actual establece que era necesaria su promulgación para que comprendiera las modificaciones derivadas de los acuerdos del Cuarto Congreso del Partido Comunista de Cuba, así como tratar de resolver todos los inconvenientes existentes en la actual ley puestos en evidencia durante su aplicación.
CubaTV conversó con el licenciado Yuliesky Amador Echevarría, maestrante en Derecho Constitucional y Administrativo, profesor de la Universidad de La Habana para entender algunas cuestiones del Sistema Electoral y la Ley Electoral de Cuba.
– ¿Cómo está caracterizado el proceso electoral cubano?
– “La Ley actual establece dos tipos de procesos electorales, las Elecciones parciales, celebradas cada dos años y medio para elegir a los delegados a las Asambleas Municipales del Poder Popular (AMPP), sus Presidentes y Vicepresidentes; y las Elecciones generales, cada cinco años, para elegir a Diputados a la Asamblea Nacional del Poder Popular (ANPP), su Presidente, Vicepresidente y Secretario, al Presidente, Primer Vicepresidente, Vicepresidentes, Secretario y demás miembros del Consejo de Estado, a los delegados a las Asambleas Provinciales del Poder Popular (APPP) y las AMPP, a sus Presidentes y Vicepresidentes.
“El voto en Cuba es libre, igual, secreto y directo. Cada elector tiene derecho a un solo voto. Para ejercerlo se debe presentar el Carnet de Identidad o documento identificativo de instituto armado. Aunque el Voto es visto como un deber cívico y moral, no tiene carácter obligatorio y prima en él la voluntariedad”.
– ¿Quién tiene la potestad para convocar a elecciones en Cuba y cómo lo hace?
– “La convocatoria a elecciones la libra el Consejo de Estado, atribución recogida en el Código Político cubano. Se publica en la Gaceta Oficial de la República con no menos de 90 días de antelación a la fecha de su celebración”.
– ¿Cuáles son las fases de las elecciones en Cuba?
“Las elecciones no constituyen sólo el acto de emitir el voto, sino que están inmersas en un proceso, un conjunto de actos relacionados que se suceden unos a otros y que como todo proceso contiene varias etapas o fases: Convocatoria, Empadronamiento o registros de electores, Nominación de candidatos, Campañas electorales y/o divulgación de candidatos, Votación, Escrutinio, Proclamación de los resultados, la Investidura del cargo y la conformación del órgano.
“La teoría socialista plantea que el ciclo electoral no concluye con la constitución de los órganos estatales elegidos ni tampoco con la renovación de estos, sino que luego de estos procesos continúa la vinculación entre electores y gobernantes de modo que aquellos puedan fiscalizar la gestión política de sus representantes en cualquier momento de su período de mandato”.
– En ocasiones suelen utilizarse como sinónimos sufragio y voto ¿Qué diferencia a un término del otro?
– “No significan lo mismo. Sufragio es un derecho político o de primera generación con un doble contenido. Otorga la facultad de elegir (sufragio activo) y la facultad de ser elegido (sufragio pasivo). Este derecho puede ser ejercitado por todos los cubanos y cubanas, incluidos los miembros de las instituciones armadas que hayan cumplido los dieciséis años de edad, que se encuentren en pleno goce de sus derechos políticos y no estén comprendidos en las excepciones contenidas en la Constitución de la República y la Ley Electoral, siendo estas la incapacidad mental previa declaración judicial, estar sancionado a privación de libertad aun cuando se encuentren disfrutando de libertad condicional, licencia extrapenal o gozando de pase, se encontrase cumpliendo una sanción subsidiaria de privación de libertad, o haber sido privados de los derechos políticos como sanción accesoria a una principal.
“Por su parte el voto es la manifestación de voluntad política del elector a favor de algún candidato mediante la cual se decide la conformación de determinado cargo público estatal”.
– ¿Qué labor realizan las Comisiones de Candidaturas?
– “Los proyectos de candidaturas son elaborados y presentados por las Comisiones de Candidaturas a todos sus niveles. Se integran por representantes de la Central de Trabajadores de Cuba, quien además la preside, los Comités de Defensa de la Revolución, la Federación de Mujeres Cubanas, la Asociación de Agricultores Pequeños, la Federación Estudiantil Universitaria y la Federación de Estudiantes de la Enseñanza Media.
“En Cuba el Partido no es sujeto activo del proceso electoral, o sea, no postula los candidatos. La facultad de nominación recae en el pueblo. La inclusión en el Registro de Electores tiene un carácter público y gratuito.
“Resultarán electos los candidatos de todas las instancias que obtengan más de la mitad del número de los votos válidos emitidos. El conteo de los votos es público. Quien resulta electo no recibe remuneración económica por ello. Una vez cumplido el objetivo para el que fueron creadas las Comisiones de Candidaturas, cesan en sus funciones”.
– ¿Quiénes pueden ser delegados o diputados y por cuánto tiempo?
– “El artículo 10 de la Ley Electoral establece la edad de 16 años como el mínimo para ser elegido como delegado a las AMPP y APPP. Puede resultar electo para ocupar el cargo de Presidente o Vicepresidente de estas. En el caso de los diputados a la ANPP la edad requerida es de 18 años. Los diputados al órgano supremo del poder del Estado en Cuba y los delegados a las APPP son elegidos por un término de cinco años, mientras que en las AMPP será por dos años y medio.
“En caso de guerra o por circunstancias excepcionales pueden ser extendidos estos términos mientras dure la circunstancia que lo originó. La Constitución vigente en su articulado expresa que la condición de diputado no entraña privilegios personales ni beneficios económicos. Deja claro además que se les puede revocar su mandato en cualquier momento en la forma, por las causas y según los procedimientos establecidos en la ley.
“Para elegir las presidencias de las Asambleas a todos los niveles el voto no es popular, pues se efectúa de forma indirecta por los miembros de las respectivas Asambleas luego de constituidas y tampoco se elige de forma directa al Consejo de Estado, ni su presidente, tomándose en consideración que es un órgano de la ANPP y a ella corresponde su elección”.
– ¿Pudiera esto significar que tenemos una verdadera Democracia y participación real en los procesos?
– “Por supuesto. Una de las características que prima en nuestro Sistema es la transparencia en cada uno de los procesos que se llevan a cabo, sobre todo teniendo en cuenta que las personas por las cuales votamos, las que nos representarán y en las que depositamos nuestra confianza, tendrán la difícil tarea de dirigir los destinos políticos de la nación sobre la base del intercambio continuo con el pueblo y una retroalimentación constante”.
– ¿Qué importancia tienen el proceso que se lleva a cabo en estos momentos en Cuba?
– “Cuba está próxima a Elecciones generales, las primeras después de 1959 sin la presencia física del Comandante en Jefe Fidel Castro, que tendrán como uno de sus rasgos distintivos el cese en el cargo de varios integrantes de la llamada generación histórica. Es de primer orden fortalecer una Educación Jurídica ciudadana sobre el Sistema Electoral. Participación real también es conocer el porqué de cada uno de los procesos de los cuales somos parte”.
Muy aclarativo, sobre todo por el lenguaje que usa. Existe algo así escrito sobre la Constitución que se pueda descargar?
